Justice Roberts: A Hack, Or The Wisest Man In America?

Like so many in this country, I was not only disappointed, but also shocked at the decision handed down by the Supreme Court on June 28th. With that decision, the government can now make us buy anything that they seem fit for us to buy, as long as they tax us for it. I refuse to believe that the Federal Government should have that kind of power. The left always throws out the argument that we are forced to buy auto insurance so what is the difference. Well my dear friends on the left, the difference is I only have to buy auto insurance if I choose to drive, now we all have to buy insurance just because we exist. When it comes right down to it, with this new bill, we are being taxed just to breathe. Moreover, that my friends, is a travesty. It is a scary thought that the government can control everything we do in the name of taxation.

Like so many others in this country, I thought Justice Roberts had sold out to the liberals on the court, or bowed to political pressure, which still might be the case. However, after stepping back and trying to analyze everything and to look on the positive side of this situation, I have come up with a different scenario, I may be completely wrong, but it is just another point of view. The bottom line is he did what he did for reasons known only to him; history will be the final judge.

The way I look at it, Justice Roberts struck down the Constitutionality of the mandate under the commerce clause, which is a good thing. With that ruling, government had its hand slapped, so the commerce clause cannot be used to force us to purchase anything.

Now Justice Roberts made it a tax, which is also a good thing. Because it is a tax, it makes it much easier to repeal. The 51 votes that is needed to repeal it, is much easier to get than 60 votes if it were not a tax. By using budget reconciliation rules to repeal the health care law, would prohibit Senate filibusters and require only 51 votes to succeed. This is a big plus.

The way it looks to me, is Justice Roberts is playing both ends against the middle. On one hand, he gave Obama a win on his health care bill; on the other hand, he made it much easier to overturn as compared to if it were under the commerce clause. He also said that his job was not to determine if it is a good bill or a bad bill, that decision is up to the people of this country. He went on to say, if the people do not like the law they should go out and vote for those representatives that will change the law.

Do not get me wrong, I myself think that the whole bill should have been struck down as unconstitutional; the government should not be able to force us buy anything, or penalize us if we do not, that should always be a personal decision. However, he did give us a way out, in his statement he literally told us what we should do next, which is to go out and overturn the law by voting it out of existence.

Look, we were dealt a hand, now we have to play it to the best of our ability. It is up to us to find a way to make chicken salad out of chicken shit. There is no doubt that this is a bad law, it is too big, it is too expensive and it is an overreach by our government by interfering with what should be a relationship between us and our doctor, the less government knows about us the better off we are. Let us follow the orders of Justice Roberts and vote for the people who will vote this law out of existence.
