Executive Order 13694: Blocking the Property of Certain Persons Engaging in Significant Malicious Cyber-Enabled Activities

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) (IEEPA), the National Emergencies Act (50 U.S.C. 1601 et seq.) (NEA), section 212(f) of the Immigration and Nationality Act of 1952 (8 U.S.C. 1182(f)), and section 301 of title 3, United States Code, I, BARACK OBAMA, President of the United States of America, find that the increasing prevalence and severity of malicious cyber-enabled activities originating from, or directed by persons located, in whole or in substantial part, outside the United States constitute an unusual and extraordinary threat to the national security, foreign policy, and economy of the United States. I hereby declare a national emergency to deal with this threat.” The Executive Order includes ten Sections, which have been summarized as follows: (Section 1) A list of cyber-crimes that will result in freezing or “blocking” the perpetrator’s assets; (2) Prohibits providing assistance to perpetrators whose property has been blocked; (3) Prohibits any transfer of assets to or from perpetrators whose property has been blocked; (4) This Executive Order (EO) applies to citizens, immigrants, non-immigrants, and any aliens or any persons with assets in the U.S. that meet the criteria listed in Section 1; (5) Prohibits conspiring to circumvent this legislation; (6) Definines terms used in the EO; (7) Perpetrators will have their assets blocked immediately, and with no prior notice; (8) Authorizes the Secretary of Treasury to take or delegate the action of blocking assets; (9) Requires the Secretary of Treasury to file reports to Congress; and (10) Legislative clarifications.
