Summary of Obama’s Executive Actions on Gun Control

The White House released a ‘fact sheet’ of the actions President Obama intends to take on gun control here, but if you don’t want to read through the extraneous wording that attempts to sell the mostly-useless and certainly expensive regulations, here are “just the facts:”

  • 24/7 availability of NICS (National Instant background Check System)
  • 230 additional ATF staff to process background checks
  • Require all members of a trust to undergo background checks for items in the trust
  • Another 200 ATF agents for enforcement activities
  • Going after illegal online firearms sales/purchases – will likely focus on auction sites, armslist and social media groups
  • request $500 million for mental health care
  • Social Security will finalize a rule to send information to NICS about people who are prohibited from possessing firearms (Current law prohibits individuals from buying a gun if, because of a mental health issue, they are either a danger to themselves or others or are unable to manage their own affairs.)
  • Make it easier for states to submit relevant information that might bar someone from purchasing firearms
  • the Departments of Defense, Justice, and Homeland Security are to conduct or sponsor research into gun safety technology
  • it doesn’t matter where you conduct your business—from a store, at gun shows, or over the Internet: If you’re in the business of selling firearms, you must get a license and conduct background checks
  • Even a few transactions, when combined with other evidence, can be sufficient to establish that a person is “engaged in the business.” For example, courts have upheld convictions for dealing without a license when as few as two firearms were sold or when only one or two transactions took place, when other factors also were present.
  • A person who willfully engages in the business of dealing in firearms without the required license is subject to criminal prosecution and can be sentenced up to five years in prison and fined up to $250,000
