A Delaware judge handed Elon Musk a loss awarding Twitter the expedited trial it requested in order to force the Tesla/SpaceX CEO to complete his $44 billion bid to buy the social media company.

Delaware Court of Chancery chancellor Kathaleen McCormick granted Twitter a five-day trial set to begin in October. The company had asked for a four-day trial to start in September.

Musk had asked the court to delay the trial until 2023.

Musk’s legal team argued that the quick trial date would not give them enough time to examine the massive amount of data that Twitter had dumped on them.

Twitter’s counsel told the judge that a speedy trial was necessary to prevent the ongoing harm to Twitter and that Musk was only pushing for the delay to allow his the debt commitments he made to financiers to expire.

The court case comes after Musk sent a legal notice to Twitter notifying them that he no longer wanted to purchase the company because the social media giant could not prove the number of real active users. Musk has sought proof of Twitter’s claim that less than 5% of its claimed users are bots.
