Louisiana Supreme Court Halts Abortion Ban

The Louisiana Supreme Court let a temporarily block of the state’s trigger abortion ban stand on Thursday.

Judge Robin M. Giarrusso had allowed a temporary injunction to go into effect June 27 blocking the state’s post-Roe abortion ban after abortion providers sued the state, according to The Washington Post. Despite the Louisiana Supreme Court’s decision to let the injunction stand Thursday, the trigger ban will likely go into effect eventually, Mary Ziegler, a law professor who specializes in abortion, told The Washington Post.

The temporary injunction extends to Friday, when a district court will hear abortion providers’ case against the abortion ban.

Hope Medical Group for Women and other abortion providers argued in their lawsuit that it was too difficult to decipher which of the state’s numerous trigger laws had gone into effect and what actions are actually prohibited, according to The Washington Post.

Louisiana is one of 13 states which had trigger laws in place to ban abortion after the overturning of the Roe precedent, which prohibited abortion restrictions prior to the point of viability, generally defined at approximately 24 weeks into a pregnancy. Texas and Kentucky’s abortion bans have also been challenged in court.

A Houston district judge blocked a 1925 Texas abortion ban June 28, but the state’s Supreme Court ruled that Friday that the law, which punishes those who perform abortions with two to 10 years in prison, could go into effect. Abortions are still being performed in Kentucky despite a 2019 trigger law banning most abortions while a judge considers legal challenges to the law.

The Louisiana Supreme Court and Hope Medical Group did not respond to the Daily Caller News Foundation’s requests for comment.
