Democrats’ Favorite Election Lawyer Marc Elias Blows Gasket Over SCOTUS District Ruling

Left-wing election lawyer Marc Elias expressed his frustration Wednesday over the Supreme Court’s ruling in a redistricting case.
The Supreme Court threw out a Louisiana map that had two districts drawn with a majority of black voters in a 6-3 ruling, calling it a “racial gerrymander” that violated the Constitution. In a statement posted on X, Elias bemoaned the decision.
“Today’s VRA decision is intellectually dishonest and wrong,” Elias wrote. “The conservatives basically said: Black people can vote for their preferred candidates, as long as they prefer the right candidates — which will be Republicans. An absolutely mockery of the law and stain on the court.”
“SCOTUS guts Section 2 of the Voting Rights Act by making it harder to challenge racially discriminatory maps,” Democracy Docket, an Elias-founded election litigation outlet, posted on Wednesday. “Today’s decision will threaten Black and brown political representation for generations in Southern states.”

“The case will return to lower courts for more proceedings, and the ~20 lawsuits on hold pending a decision in Callais will likely move forward,” Democracy Docket added in another post on the thread. “Florida — the only state left in the ongoing redistricting war — could benefit from today’s decision before the 2026 election.”
Republican Florida Gov. Ron DeSantis unveiled new maps for the state Monday, which could make the state’s delegation even more Republican.
Elias, who has extensively represented the Democratic Party in election-related legal battles and elsewhere, launched Democracy Docket in 2020 and is listed as the outlet’s founder. Elias represented Democratic interests in litigation before, during and after the 2020 presidential election.

Elias was involved in creating the now-debunked Steele dossier, a key source used to justify the FBI’s investigation into allegations that the Trump campaign colluded with Russia, during his time working at the Perkins Coie law firm. Special counsel John Durham released a report on May 15, 2023, on the origins of the FBI investigation of allegations that Trump’s 2016 presidential campaign colluded with Russia that found that the FBI “did not and could not corroborate” the claims from the now-discredited dossier.
